Nanny and Caregiver Overtime: What Families Owe
Since 2015, most household employees, including nannies and home care aides employed through agencies, have been covered by FLSA overtime: 1.5× after 40 hours a week. Live-in domestic workers are exempt from federal overtime, but states like California, New York and Massachusetts have their own rules. For example, New York requires OT after 44 hours for live-ins.
Tips
- Agree on a regular rate in writing.
- Track hours daily.
- A flat weekly salary does not remove overtime.
